File Destruction

Purge

Absolute discharges occuring AFTER July 1992 are automatically removed from a criminal record 1 year from the date of the sentence. Conditional discharges occuring AFTER July 1992 are automatically removed from a criminal record 3 years following the date of the sentence.

Absolute discharges and Conditional discharges received BEFORE July 1992 require a Purge application to be removed from a criminal record. This process takes 4-6 months.

If your record includes Absolute discharges or Conditional discharges AND other convictions, then a Pardon is required to clear everything from the record.

File Destruction

If charges against you were dismissed, stayed or withdrawn, they will remain on the RCMP system and appear on your criminal record. A File Destruction is required to clear these charges from your record.

If your record consists of these types of charges AND charges for which you were convicted, then you will require a Pardon to clear everything from your record.

The File Destruction application is submitted to the arresting police force and requests that your fingerprints, photographs, and all information pertaining to your arrest be destroyed. This process takes 4-6 months.
